TLDSpy API - Terms of Service

1. Acceptance of Terms

Welcome to TLDSpy API ("Service"), provided by Mon Agence Creative ("TLDSpy," "we," "us," or "our"). By accessing or using the TLDSpy API, whether through a free or paid subscription, you ("User," "you," or "your") signify your agreement to these Terms of Service ("ToS"). If you do not agree to these ToS, you must not access or use the TLDSpy API.

2. Description of Service

TLDSpy API is a domain intelligence API providing real-time Top-Level Domain (TLD) pricing data, registrar information, and domain utility services (DNS lookups, WHOIS, SSL, Status checks) as described on our landing page. The API is designed to provide data for developers, domain investors, resellers, and industry analysts.

3. Beta Service

You acknowledge that TLDSpy API is currently offered in BETA form. This means the Service is still under development and testing. As such, you understand and agree that:

  • The Service may contain bugs, errors, or inaccuracies.
  • Features and functionality may be added, removed, or changed at any time without prior notice.
  • Service uptime and data accuracy are provided on a best-effort basis and are not guaranteed.
  • We recommend not relying on the Service for mission-critical operations during the BETA phase.
  • We encourage you to provide feedback to help improve the Service.

4. Account Registration and API Keys

  • To access the TLDSpy API, you may be required to register an account and obtain an API key.
  • You are responsible for maintaining the confidentiality of your account credentials and API key.
  • You are responsible for all activities that occur under your account and API key, whether authorized by you or not.
  • You agree to provide accurate and complete information when registering and to keep your account information updated.
  • API keys are personal to you and should not be shared with unauthorized individuals.

5. Use of the API

  • Permitted Use: You may use the TLDSpy API solely for your internal business purposes, including but not limited to:
    • Comparing TLD prices across registrars.
    • Tracking TLD pricing trends.
    • Developing domain-related tools or applications.
    • Conducting domain industry research and analysis.
  • Prohibited Use: You agree not to use the TLDSpy API in any way that:
    • Violates any applicable law or regulation.
    • Infringes upon the rights of TLDSpy or any third party, including intellectual property rights.
    • Is abusive, harassing, threatening, defamatory, or otherwise objectionable.
    • Is used for any illegal, unethical, or unauthorized purpose.
    • Attempts to circumvent rate limits or access features beyond your subscription tier.
    • Involves excessive or abusive API call volume that may negatively impact the Service or other users (as determined by TLDSpy in its sole discretion).
    • Involves scraping, data mining, or otherwise extracting data from the TLDSpy API for redistribution, resale, or creating a competitive service without explicit written permission from TLDSpy.
    • Misrepresents your identity or affiliation.

6. Data Usage and Limitations

  • Data Accuracy: TLDSpy API provides data collected from third-party sources (domain registrars). While we strive for accuracy and timeliness, we do not guarantee the completeness, accuracy, or real-time nature of the data. TLD pricing and other information are subject to change by registrars without notice.
  • Pricing Information:
    • All prices are provided in USD (United States Dollar).
    • Prices include ICANN fees ($0.18 USD per domain).
    • Some registrars may have region-dependent pricing. The API returns prices for the default region (usually US/Global).
    • Price history data is only available from February 2025 onwards.
    • Promotional prices and offers are subject to registrars' terms, conditions, and availability.
    • Multi-year cost calculations are based on standard pricing (registration + renewals) and do not account for potential discounts that some registrars may offer when purchasing multiple years upfront.
  • No Endorsement of Registrars: The inclusion of any registrar's pricing data in the TLDSpy API does not constitute an endorsement of that registrar by TLDSpy.
  • Data Redistribution Restrictions: You may not redistribute, resell, or publicly display the raw data obtained from the TLDSpy API without explicit written permission from TLDSpy. You may use the data within your internal applications and for your own analysis, provided it aligns with the "Permitted Use" section.
  • Fair Use Policy: Your API usage must be consistent with fair use principles and the limitations of your subscription tier. Excessive or abusive usage may result in rate limiting, suspension, or termination of your account, at TLDSpy's sole discretion.

7. Payment and Subscription Terms (For Paid Plans)

  • Subscription Tiers: TLDSpy API offers tiered subscription plans with varying features, API call limits, and pricing as described on our Pricing page. The URL to the Pricing page should be provided here.
  • Fees and Billing: Subscription fees are billed monthly or annually in advance, depending on your chosen plan. All fees are non-refundable except as explicitly stated in our Refund Policy (if applicable).
  • Payment Methods: You agree to provide valid payment information and authorize TLDSpy to charge the applicable subscription fees to your chosen payment method.
  • Auto-Renewal: Paid subscriptions will automatically renew at the end of each billing cycle unless you cancel your subscription prior to the renewal date.
  • Price Changes: TLDSpy reserves the right to change subscription fees at any time. We will provide reasonable notice of any price changes.
  • Taxes: You are responsible for all applicable taxes related to your use of the TLDSpy API.
  • Free Tier: The "Hobbyist" tier is offered free of charge but is subject to usage limitations and feature restrictions as described on our Pricing page. TLDSpy reserves the right to modify or discontinue the free tier at any time.
  • Refunds: Refunds are provided at the sole discretion of TLDSpy and are typically not offered for partial months or unused API calls.
  • Downgrades and Upgrades: You may upgrade or downgrade your subscription tier at any time through your account settings. Downgrades may result in feature limitations and will take effect at the start of the next billing cycle. Upgrades will take effect immediately, and you may be charged a pro-rated amount for the upgraded tier for the current billing cycle.

8. Intellectual Property

  • TLDSpy API and Content: The TLDSpy API, including all underlying software, algorithms, data, documentation, and website content, is owned by Mon Agence Creative and protected by copyright, trademark, and other intellectual property laws.
  • Limited License: Subject to these ToS and your subscription tier, TLDSpy grants you a limited, non-exclusive, non-transferable, revocable license to access and use the TLDSpy API for the Permitted Uses.
  • No Ownership Transfer: These ToS do not transfer any ownership rights in the TLDSpy API or its content to you.

9. Disclaimer of Warranties

THE TLDSpy API AND ALL DATA AND INFORMATION PROVIDED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TLDSpy DOES NOT WARRANT THAT:

  • THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
  • THE DATA PROVIDED WILL BE ACCURATE, COMPLETE, OR TIMELY.
  • THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

YOUR USE OF THE TLDSpy API IS AT YOUR SOLE RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Mon Agence Creative, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE TLDSpy API, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF TLDSpy HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL TLDSpy'S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE TLDSpy API EXCEED THE AMOUNT YOU PAID TO TLDSpy, IF ANY, DURING THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.

11. Indemnification

You agree to indemnify, defend, and hold harmless Mon Agence Creative and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of the TLDSpy API in violation of these ToS.
  • Your violation of any applicable law or regulation.
  • Your infringement of any intellectual property or other rights of any third party.
  • Any content or data you transmit or process using the TLDSpy API.

12. Termination

  • Termination by You: You may terminate your subscription at any time through your account settings. Termination will be effective at the end of your current billing cycle.
  • Termination by TLDSpy: TLDSpy may terminate or suspend your access to the TLDSpy API at any time, with or without cause, and with or without notice, including but not limited to violations of these ToS, non-payment of fees, or abusive usage.
  • Effect of Termination: Upon termination, your right to access and use the TLDSpy API will immediately cease. You will not be entitled to any refund of subscription fees upon termination by TLDSpy for cause. Sections relating to Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law will survive termination.

13. Modifications to Terms of Service and Service

TLDSpy reserves the right to modify these ToS at any time. We will notify you of any material changes by posting the updated ToS on our website or through other reasonable means. Your continued use of the TLDSpy API after the effective date of any modifications to the ToS constitutes your acceptance of the updated ToS.

TLDSpy also reserves the right to modify, suspend, or discontinue the TLDSpy API (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

14. Governing Law and Dispute Resolution

These ToS shall be governed by and construed in accordance with the laws of France, Ville-Franche-Sur-Saone, without regard to its conflict of laws principles. Any dispute arising out of or relating to these ToS or the TLDSpy API shall be subject to the exclusive jurisdiction of the courts located in Ville-Franche-Sur-Saone.

16. Entire Agreement

These ToS constitute the entire agreement between you and Mon Agence Creative concerning the TLDSpy API and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and TLDSpy with respect to the Service.
